Terms of Service
Last updated: 7 November 2026
These terms govern your use of Kitomi, a voice assistant app for macOS, and the website kitomi.app (together, the "Service"), provided by Masoud Vatankhah ("we", "us"). By installing or using Kitomi you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. The Service
Kitomi lets you talk or type to an assistant that answers questions and, when you ask, acts on your Mac and on services you connect (such as Messages, Mail and Gmail). Features may change, and some may be offered on a trial or paid basis.
2. Using Kitomi
- You must be old enough to form a binding contract where you live, and at least 13 years old.
- You are responsible for your Mac, your accounts and your use of the Service, and for keeping your credentials safe.
- You will not use Kitomi to break the law, to harm or harass others, to send spam or unsolicited bulk messages, to infringe others' rights, or to attack, probe or overload the Service or other systems.
- You will not copy, resell, reverse engineer or build a competing service from Kitomi's servers or interfaces, except where the law allows it despite this term.
3. Connected services and your approval
When you connect an account such as Gmail, you authorize Kitomi to use it as described in the Privacy Policy and the permissions you approve in Google's consent screen. Use of those services remains subject to their own terms (for Google, the Google Terms of Service). You can disconnect at any time.
Kitomi asks for your approval before sending a message or email, forgetting stored information and similar actions, and you can set other tools to ask first or to be off. Once you approve an action, you are responsible for it, including for the content that is sent.
4. AI-generated content
Kitomi uses AI models. Their output can be wrong, incomplete or out of date, and speech recognition can mishear you. Check anything important before you rely on it or approve it, and don't use Kitomi as a substitute for professional medical, legal, financial or safety advice. Prices, news and similar information come from third-party sources we don't control.
5. Your content
You keep all rights in your content (your messages, emails, files and requests). You give us only the limited permission needed to process it to provide the Service to you, as described in the Privacy Policy.
6. Our rights
Kitomi, its character, name, logo and software are owned by us or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable licence to use Kitomi on your own devices under these terms. Third-party and open-source components are used under their own licences.
7. Availability, changes and ending
We may change, suspend or stop any part of the Service, and we may update these terms; if a change is significant we will tell you in the app or on this site, and your continued use after that means you accept it. You can stop using Kitomi at any time by uninstalling it and disconnecting your accounts. We may suspend or end your access if you break these terms or put the Service or others at risk.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and uninterrupted or error-free operation, to the extent the law allows.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for it in the twelve months before the claim, or, if you paid nothing, to a nominal amount. Nothing in these terms limits liability that cannot be limited by law.
